1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Tailored Wanders ("I," "me," or "my") regarding your use of my website tailoredwanders.com and travel planning services.

By accessing my website or using my services, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use my services.

2. Description of Services

Tailored Wanders provides personalized travel planning services, including but not limited to:

• Custom travel itinerary planning and design
• Destination research and recommendations
• Accommodation booking assistance
• Activity and experience recommendations
• Travel logistics coordination
• Travel consultation and advisory services
• Budget planning and cost optimization

My services are consultative and planning-focused. I am not a travel agency and do not operate as a tour operator. I provide recommendations and planning services, but you are responsible for making your own bookings and travel arrangements unless otherwise specified.

3. User Responsibilities

As a user of our services, you agree to:

• Provide accurate and complete information about your travel preferences and requirements
• Communicate clearly and promptly regarding any changes to your travel plans
• Pay all agreed-upon fees in a timely manner
• Verify all travel information, including visas, passports, and health requirements
• Purchase appropriate travel insurance
• Comply with all local laws and regulations during your travels
• Not use my services for any illegal or unauthorized purposes
• Respect my intellectual property and confidential information

4. Payment Terms

4.1 Service Fees

My service fees are clearly communicated before you engage my services. I offer flexible payment options to suit your preferences:

• Split Payment: 50% deposit to begin planning services, with the remaining balance due upon delivery of final itinerary
• Full Upfront Payment: 100% payment at the start of the planning process (optional)
• Payment Methods: Bank transfer, PayPal, or other mutually agreed methods

4.2 Third-Party Costs

You are responsible for all third-party costs including but not limited to:

• Flights, accommodations, and activities
• Travel insurance
• Visas and travel documents
• Meals and incidental expenses
• Currency exchange fluctuations

5. Cancellation and Refund Policy

My service consists of creating personalized travel plans and itineraries. Once a plan is completed and delivered, my work is finished regardless of whether you proceed with the actual travel.

5.1 Service Cancellation by Client

• During Planning Process: If you cancel while we are actively working on your travel plan (before delivery), you are eligible for a refund equal to 50% of the total agreed service fee, regardless of how much you have already paid
• After Plan Delivery: Once your completed travel plan has been delivered to you, no refunds are available as my service has been fully provided
• Non-Travel Does Not Equal Refund: If you choose not to proceed with your actual trip after receiving your plan, this does not qualify for a refund as my planning service has been completed

5.2 Service Cancellation by Tailored Wanders

I reserve the right to cancel services in exceptional circumstances. In such cases, I will provide a full refund of fees paid for uncompleted planning services and assist in transferring your requirements to another qualified travel planning service provider where possible.

6. Limitations of Liability

My liability is limited to the fees paid for my planning services. I am not liable for:

• Travel delays, cancellations, or disruptions
• Changes in pricing by third-party providers
• Natural disasters, political unrest, or force majeure events
• Personal injury, illness, or property damage during travel
• Dissatisfaction with third-party services we recommend
• Currency fluctuations or changes in exchange rates
• Visa denials or travel document issues
• Lost or delayed luggage
• Any costs exceeding the fees paid for my planning services

7. Travel Insurance Requirement

I strongly recommend and may require that you purchase comprehensive travel insurance covering:

• Trip cancellation and interruption
• Medical expenses and emergency evacuation
• Baggage loss and delay
• Travel delays and missed connections
• Personal liability coverage

You acknowledge that travel insurance is your responsibility and that I am not liable for costs that travel insurance would typically cover.

8. Force Majeure

Neither party shall be liable for any failure or delay in performance due to events beyond their reasonable control, including but not limited to natural disasters, war, terrorism, epidemics, government actions, strikes, or other force majeure events. In such cases, I will work with you to reschedule or modify services as appropriate.

9. Intellectual Property

All content, designs, itineraries, and materials created by Tailored Wanders remain my intellectual property. You may use the materials for your personal travel purposes but may not:

• Reproduce, distribute, or sell my content without permission
• Use my materials for commercial purposes
• Share detailed itineraries with other travel planning services
• Remove copyright or proprietary notices

10. Privacy

Your privacy is important to me. My collection and use of personal information is governed by my Privacy Policy, which is incorporated into these Terms by reference.

11. Dispute Resolution

I am committed to resolving any disputes amicably. In case of disagreements:

• Contact me first to discuss the issue directly
• I will work in good faith to find a mutually acceptable solution
• If resolution is not possible, disputes will be resolved through binding arbitration
• These Terms are governed by Polish law

12. Changes to Terms

I reserve the right to modify these Terms at any time. Updated Terms will be posted on my website with a new "Last updated" date. Continued use of my services after changes constitutes acceptance of the modified Terms. For existing service agreements, changes will apply to future services unless otherwise agreed.
